The Daubert Standard is used by a judge to make a preliminary assessment of whether an expert’s testimony is based on reasoning or methodology that is scientifically valid and can properly be applied to the facts at issue.
Case law relevant to this standard was established by Daubert v. Merrell Dow Pharmaceuticals, Inc., 509 U.S. 579 (1993) which was presented and affirmed in front of the United States Supreme Court. The Daubert Standard is currently used in the federal court system, 40 state courts (including Arizona, Colorado, and Texas), and in the District of Columbia.
On August 28, 2020, the Court of Appeals of Maryland adopted the Daubert v. Merrell Dow Pharmaceuticals, Inc., 509 U.S. 579 (1993). Since our neighboring jurisdiction has recently adopted the standard it’s the perfect occasion for a refresher on the Daubert standard in D.C.
We are very excited to have Barry Nace give us a history and background of the original Daubert case and James Green and Michelle Parfitt are going to give a talk about the Motorola case which set the standard in DC.
As we get ready to get back in the courtroom in 2021, we can make sure we have these tools in our toolbox to make sure we get our experts properly qualified and their testimony admitted.
